Bloomington, Ill -- McLean County Unit 5 school bus drivers and monitors see a preliminary injunction against the school district as a temporary victory in workers' rights.
A two-day hearing concluded this evening, temporarily halting the layoffs of 171 workers until the Illinois Education Labor Relations Board reaches a decision.
AFSCME petitioned to interrupt the school district's contract with third party First Student Incorporated to provide bus transportation and maintenance.
Regardless of today's ruling, First Student can still hire additional workers to fulfill bus route needs for Unit 5.
"As far as setting up routes, beginning to run the routes, running mock days, assigning routes, all of those things can be done with First Student," says Superintendent Dr. Gary Niehaus.
AFSCME Local 31 Staff Representative Renee Nestler says this is about more than just hiring addition drivers.
"Their effort in out-sourcing has been a retaliatory act for voting in the union last fall in addition to some issues with not bargaining in good faith with us," Nestler says.
AFCSME workers believe Unit 5 hired First Student to break up their unionization last October.
Until the Labor Relations Board reaches a decision, drivers and monitors are guaranteed employment with benefits.
That is, unless the district provides just cause for termination.
